1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Rathunas PDF Solutions LLC ("Company," "we," "us," or "our"), governing your access to and use of ZiteBuilder, the website-building platform available at zitebuilder.com (the "Service").

By accessing or using the Service, creating an account, or clicking any "I Agree" or equivalent button, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ZiteBuilder is a cloud-based website builder that allows users to create, edit, and publish websites using a drag-and-drop visual editor, AI-assisted content generation, and professionally designed templates. Published sites are hosted on ZiteBuilder's infrastructure and served via subdomains (e.g., yoursite.zitebuilder.com) or custom domains.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. Account Registration

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at support@zitebuilder.com if you believe your account has been compromised. We are not liable for any loss or damage arising from your failure to protect your credentials.

We reserve the right to terminate or suspend accounts that violate these Terms or that have been inactive for an extended period, with reasonable advance notice where practicable.

4. Subscription Plans and Pricing

ZiteBuilder offers the following paid subscription plans. All prices are in U.S. dollars (USD).

Prices are subject to change at any time. We will notify you of any price changes via email or a prominent notice in the Service. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.

5. Trial Periods and Automatic Renewal

The Beginner Trial and Builder Trial plans begin with a 14-day introductory period charged at a reduced rate ($1.45 and $1.95 respectively). At the end of the trial period, your subscription will automatically renew at the full monthly rate of $49.95 per month unless you cancel before the trial expires.

The Builder Annual plan has no trial period and is billed at $299.00 per year upon enrollment. Annual subscriptions automatically renew at the then-current annual rate unless cancelled at least 24 hours before the renewal date.

By enrolling in any plan, you authorize us to charge your payment method on the applicable billing cycle. It is your responsibility to cancel before renewal if you do not wish to be charged.

6. Billing, Payment, and Taxes

Payment is due at the time of purchase and at each renewal. We accept major credit and debit cards. All charges are processed in USD. You are responsible for providing accurate billing information and for ensuring your payment method remains valid.

You are responsible for all applicable taxes, levies, and duties imposed by any taxing authority. Where required by law, we will collect and remit applicable sales tax on your behalf.

If a payment fails, we may suspend access to your account and retry the charge. Continued failure to pay may result in termination of your subscription and loss of access to published websites.

7. Cancellation and Refund Policy

You may cancel your subscription at any time by contacting us via email at support@zitebuilder.com. Cancellation is effective at the end of the current billing period; you retain access until that date.

30-Day Money-Back Guarantee: If you are not satisfied with the Service, you may request a full refund within 30 days of your initial purchase or subscription renewal. Refunds are not available after 30 days.

Trial charges ($1.45 or $1.95) are fully refundable if the subscription is cancelled within the 14-day trial period. Refunds are processed to your original payment method within 5–10 business days.

8. Acceptable Use

You agree not to use ZiteBuilder to:

• Publish or distribute illegal, defamatory, hateful, harassing, or fraudulent content.
• Infringe any third party's intellectual property, privacy, or other rights.
• Distribute malware, spyware, phishing pages, or other malicious code.
• Violate any applicable local, state, national, or international law or regulation.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the Service in a manner that imposes an unreasonable or disproportionate load on our infrastructure.
• Resell or sublicense access to the Service without our express written consent.
• Create, allude to, or publish any content containing profanity or obscene language of any kind.
• Create, allude to, or publish any content promoting, depicting, or referencing illegal drugs, controlled substances, or drug-related paraphernalia.
• Create, allude to, or publish any discriminatory content targeting individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Create, allude to, or publish any sexual, adult, explicit, or pornographic content of any nature.

We reserve the right to remove content or terminate accounts that violate this policy without prior notice or refund.

Prohibited Content Policy

When publishing a website through ZiteBuilder at zitebuilder.com, you understand and agree that you are strictly prohibited from creating, alluding to, or publishing any content, pages, data, or websites that include or relate to:

• Profanity or obscene language of any kind.
• Illegal drugs, controlled substances, or drug-related paraphernalia.
• Discriminatory content targeting individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Sexual, adult, explicit, or pornographic content of any nature.

ZiteBuilder expressly waives all liability for any content created, alluded to, or published by users through the use of ZiteBuilder's tools. You are solely responsible for all content you create, publish, or distribute through the Service.

If ZiteBuilder determines, in its sole discretion, that you have violated this Prohibited Content Policy, ZiteBuilder retains the right to:

• Share all relevant user data — including account information, published content, and activity logs — with the relevant governmental or law enforcement authorities;
• Permanently ban your account from the Service; and
• Remove all of your websites and associated content without the option of a refund.

All disputes arising from the enforcement of this policy shall be handled in accordance with Section 13 (Governing Law and Dispute Resolution) of these Terms.

9. Intellectual Property

Your content: You retain all ownership rights in the content you upload, create, or publish through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, transmit, and display your User Content solely as necessary to provide the Service.

Our content: All software, templates, designs, logos, trademarks, and other materials provided by ZiteBuilder are the exclusive property of Rathunas PDF Solutions LLC or its licensors. You may not copy, modify, distribute, or create derivative works from our materials without express written permission.

AI-generated content: Content generated by ZiteBuilder's AI tools is provided as-is for your use. You are solely responsible for reviewing, editing, and ensuring the accuracy and legality of any AI-generated content before publishing.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data collection and use practices.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RATHUNAS PDF SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rathunas PDF Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Santa Cruz County, California, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify you by email or a prominent notice in the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
